Professor Day earned his B.S. from the University of Pennsylvania in 1951 and his J.D. from the University of Michigan Law School in 1957, where he served on the Michigan Law Review. He was admitted to practice law in Illinois in 1957, the District of Columbia in 1959, and South Carolina in 1978. He practiced law at Kirkland & Ellis in Chicago, from 1957 to 1958, and at Howrey & Simon in the District of Columbia, from 1958 to 1961.

He taught as an Assistant Professor of Law at the University of North Carolina School of Law from 1961 to 1964; as an Associate Professor of Law at the Ohio State University College of Law from 1964 to 1966; as a Visiting Associate Professor of Law at the University of Virginia School of Law in the fall of 1965; and as a full Professor of Law at the Ohio State University College of Law from 1966 to 1975. After teaching as a Visiting Professor of Law at the University of South Carolina School of Law in the fall of 1974, Professor Day was hired as a full Professor of Law in 1975. He served as Dean of the University of South Carolina School of Law from 1977 to 1980, when he stepped down to return to teaching full time. In 1999 the Law School honored him with the title of Distinguished Professor Emeritus of Law.

He has taught and conducted research in Remedies, Consumer Protection, and Intellectual Property, with a special interest in Antitrust, a topic about which he has written extensive articles.

Professor Day has served as a member of the American Law Institute; as a member of The Antitrust Bulletin from 1968 to present; as a Commissioner, National Conference of Uniform State Law Commissioners for Ohio from 1968 to 1975 and South Carolina from 1977 to 1980; and as member of the Legal Advisory Board of the Journal of Reprints for Antitrust Law & Economics since 1974.
